These Terms & Conditions govern your use of the Optifygentic website and, if you become a client, the services described in your written proposal, invoice, subscription, or service agreement. By using the website or engaging Optifygentic, you agree to these terms.

About Our Services

Optifygentic provides practical marketing and customer-follow-up support for local service businesses. Services may include Google Visibility Audits, reputation support, genuine review-request workflows, Google Business Profile support, website conversion support, reporting, and related implementation services.

The exact scope, price, included features, timeline, and payment terms for a client engagement are the ones shown in the applicable written proposal, invoice, subscription, or service agreement. If a written agreement conflicts with these website terms, the written agreement controls.

No Guarantees

Marketing results depend on many factors outside our control. Optifygentic does not guarantee a particular number of reviews, star rating, search ranking, lead volume, booked jobs, revenue, or business outcome. We provide services in good faith and communicate progress based on available information.

Client Responsibilities

Clients are responsible for providing accurate business information, reviewing and approving messages and public-facing content when requested, protecting their account credentials, and promptly telling us about changes that affect their service.

Before any client customer information is entered into a review-request or follow-up system, the client is responsible for having the appropriate permission or other lawful basis to use that information. The client is also responsible for ensuring its own business practices, customer communications, and offers comply with applicable law and platform policies.

Genuine Review Practices

Optifygentic supports genuine customer feedback after real customer experiences. We do not create fake reviews, buy reviews, offer rewards conditioned on positive reviews, use review gating, or filter requests based on expected sentiment. Clients agree not to use our services for these prohibited practices.

Messaging and Consent

Text messages and emails are not activated until the client has approved the workflow and completed applicable sender, consent, and opt-out requirements. Clients must not instruct Optifygentic to message people who have not provided appropriate permission or who have opted out. Clients remain responsible for the customer relationships and contact information they provide.

SMS Communications

Optifygentic sends inquiry, requested-audit, phone-call-request, and related follow-up text messages only to people who voluntarily opt in through our website.

You can cancel the SMS service at any time. Just text STOP to 978-882-9782. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

Message and data rates may apply. Message frequency varies. If you have questions about your text plan or data plan, contact your wireless provider.

You must be 18 years of age or older, or have authority to provide the phone number and consent.

Client Data and Account Access

A client may receive access to an Optifygentic-branded account or dashboard. The account is provided to support the agreed services. Client data remains the client's information, subject to the permissions needed to operate and support the service. We may use trusted technology providers to deliver the service.

Website Use and Intellectual Property

The content, branding, and materials on this website belong to Optifygentic or are used with permission. You may use the website for lawful, personal, or internal business purposes. You may not copy, resell, misuse, interfere with, or attempt to access parts of the website or services without authorization.

Confidentiality

Each party should treat non-public business, customer, workflow, pricing, and account information received from the other party as confidential, except when disclosure is required by law or reasonably necessary to provide the agreed services.

Third-Party Services

Our services may work with third-party websites, communications providers, payment processors, review platforms, and other technology services. Those providers operate under their own terms and policies. Optifygentic is not responsible for a third party's availability, policy changes, outages, suspensions, or decisions.

Limitation of Liability

To the fullest extent permitted by law, Optifygentic is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of business opportunity. Nothing in these terms limits liability that cannot legally be limited.

Changes, Suspension, or Termination

Either party may end a service relationship according to the applicable written agreement, subscription terms, or if a client directs us to engage in prohibited or noncompliant conduct.

Changes to These Terms

We may update these terms as our business, services, or legal requirements change. The current version will be posted on this page with a revised date.
